Foreign citizens can buy land in Mexico. If the property is not in the restricted zone (within 50 kilometres from the coast or 100 kilometers from the border), then the property can be notarized directly abroad. If the ground is within a restricted zone, then abroad may be owner of the property through a “Trust” or through a mexican association .

There are two ways to hold title deeds to foreigners in Mexico. These are: the FIDEICOMISO or through a MEXICAN CORPORATION.

The following information explains how to hold a title owned by a trust. A notary public or a lawyer can offer more guidance in relation to these two forms of property titles.

What is a FIDEICOMISO and who requires a trust property?

Since 1973, a constitutional amendment known as the Foreign Investment Law allows non-Mexicans, acquire properties on the coast and along the border through a trust, which is established through a Mexican bank. This trust assured the foreign buyer all the rights and privileges of possession, and is required to own property in what is known as the “restricted zone”.

Any property located within 50 kilometers (32 miles) from the coast or 100 kilometers (64 miles) of any border is known as the “restricted zone”, as stipulated in Article 27 of the Mexican Constitution 1917. Since 1994, the Foreign Investment Law dictates that the trust must be for a term of 50 years, with renewal at any time during its existence with the simple request. The beneficiary can rent, sell or transfer the property at any time.
